One of the world’s strictest anti-LGBTQ legislation was signed by Ugandan President Yoweri Kaguta Tubuhaburwa Museveni on May 29, 2023. The Ugandan parliament approved the bill, which is now an act, on May 2, 2023. The legislation calls for harsh anti-gay laws, including the execution of those who engage in “aggravated homosexuality”.
What is in The Uganda Anti-Homosexuality Bill
For “serial offenders” of the legislation and the spread of a fatal sickness like HIV/AIDS through gay intercourse, it calls for the death penalty. A 20-year sentence is also imposed for “promoting” homosexuality.
Bugiri Municipality Member of Parliament, Hon Asuman Basalirwa, the bill’s proponent, informed media that parliament speaker Anita Among’s U.S. visa was revoked as soon as the law was put into effect. Requests for response from both Among and the U.S. embassy in Uganda were not promptly fulfilled at the time of writing this.
The bill also prescribes a death penalty for the offence of spreading HIV/AIDS. This particular clause attracted furry from the western world. UNAIDS responded with a vailed threat to withdraw HIV fund support in the light of this law.
The maximum term under current Ugandan legislation for willfully transferring HIV is 10 years, but this does not apply when the individual who acquired the infection was aware of their sexual partner’s HIV status. A life sentence exists in the new law for same sex offenders!
The above might be a loophole that potential petitioners might exploit to quash this law in the constitutional court. If quashed, this will not be the first time court throws out this bill. In August 2014, court annulled a similar bill for being unconstitutional.
The other glaring loophole is that the new law has no exception based on knowledge of HIV status and does not distinguish between intentional and unintentional transmission. Its expected that this will be contested by civil society.
Uganda will face pressure from western countries over this law. To demonstrate this, parliament Speaker, Anita Among Anite’s US Visa was cancelled hours after the president signing the bill.
